  • Filing a Complaint

     

    In order to file a complaint/report an incident, you must fill out an incident report form and have it turned in to the Office of Greek Life within five (5) business days of the event in question.  All incident reports will be reviewed by the Vice President of Judicial Affairs. Your input is appreciated in all issues and we are very interested in mediating conflict with both proactive and appropriate measures.

    Judicial Board Hearing Protocol

     

    Allegation/Incident Report

    The Vice President of Judicial Affairs will receive all Incident Reports.  After receiving the Incident Report, the VP of Judicial Affairs will look over the report and determine a proper course of action with the assistance of a staff member in the Office of Greek Life.  If further action is required, a letter detailing the charges, date, time, and location of the reported incident will be sent to the president of the chapter in question.

    Charge Letter

    A letter detailing the alleged infractions of the fraternity in question must be sent out to that chapter's president within five business days.  The letter will detail the specific charges as well as the date, time, location, and individuals involved in the incident; it will also contain a hearing date and time. The charge letter will also be sent to the Greek Life advisory as well as the IFC president.

    Hearing

    A hearing for the chapter will be held on the date prescribed in the charge letter.  At the hearing, the Judicial Board will review the case as well as ask for clarifying information from the chapter president and/or other involved individuals.  Chapters should bring witnesses as well as any information that would dispute the claims made against them at this time with the understanding the that Judicial Board will likely question the chapter's witnesses as well.

    Post-Hearing

    After the closing statement from the president of the chapter in question, the Judicial Board will convene in a closed meeting to determine responsibility and sanctions if applicable. After a decision is made a letter detailing the decisions and sanctions (if applicable) will be sent to the president of the chapter in question.  The Judicial Board may ask the president to reappear after deliberations so that the decisions of the Judicial Board can be explained in detail. If sanctions are determined to be necessary by the Judicial Board, they go into effect immediately unless otherwise noted.

     
    Hearing Procedure

     

    The following is a summary of the procedures followed during a Judicial Board hearing. If you have any questions regarding the procedures, feel free to contact the Vice President of Judicial Affairs.

    Pre-Hearing

    1. The Vice President of Judicial Affairs reviews the incident report and evidence with the Judicial Board.

    2. Questions to clarify ambiguous events are composed.

    3. The sequence of events in reviewed.

    Hearing

    Introduction

    1. Opening statement by IFC Vice President of Judicial Affairs.

        Rights of Respondents:

    • May have an adviser
    • May request permission for certain persons to be present during hearing
    • May comment on material contained in Judicial Board file
    • May present documentary evidence or statements for consideration by the Judicial Board.

    2. Introduction of Judicial Board.

    3. Introduction of respondent.

    4. Procedural questions.

    Allegations

    1. Organization response(s) to allegations.

    2. Opening statement by organization (limited to 3 minutes per person).

    Information in Support of Allegation

    1. The Judicial Board will read statements in support of allegations.

    2. The Judicial Board will show pictures in support of allegations.

    3. The Judicial Board may call witnesses in support of the allegations.

    Information in Support of the Respondent(s)

    1. Respondents may call witnesses in their support.

    2. Respondents may provide evidence that disputes evidence in support of the allegations.

    Closing Statement

    1. A closing statement will be issued by the organization (limited to 3 minutes per person).

    Deliberations

    1. Review facts.

    2. Determine in violation or not in violation.

    3. If in violation, review all facts in extenuation or mitigation

    4. If in violation, determine appropriate action.

     
    Appeals Process

     

    If a chapter should choose to appeal a decision made by the Judicial Board, the chapter's written intent to do so must be received by the Vice President of Judicial Affairs within ten (10) school days of receiving the sanctions letter; as soon as the organization is informed of their sanctions, they will be inforced.

    When the chapter in question informs the IFC Vice President of Judicial Affairs in writing of their intent to apeal, the sanction will be lifted until the appeals process is completed. It will take two-thirds majority of the Judicial Board to send the appeal to the Vice President of Judicial Affairs and the Office of Greek Life.  If the VP of Judicial Affairs and the Office of Greek Life do not overturn the sanctions, the time between the appeal notification and the appeal will be added to the end of the sanction.

    The Vice President of Judicial Affairs and the Office of Greek Life will make the final decision on all appeals; a decision regarding an appeal must be made within ten (10) school days.
